Please read these Terms & Conditions of Sale carefully before placing an order on titretrois.com.

These Terms govern the purchase of products from the TITRE TROIS online store and apply to orders placed through the Website.

By placing an Order, the Customer confirms that they have read, understood and agreed to these Terms.

2. DEFINITIONS

Seller / TITRE TROIS / We / Us – Individual Entrepreneur “Galiullina”, operating the TITRE TROIS online store.

Customer / You – a person placing an Order through the Website.

Consumer – an individual purchasing Goods primarily for personal purposes and not for purposes related to their trade, business, craft or profession.

Goods / Products – products offered for sale through the Website.

Order – a request submitted by the Customer to purchase one or more Products through the Website.

Delivery Service – a third-party courier, postal or logistics company engaged in delivering Orders.

These Terms are primarily intended for consumer purchases. Purchases made for commercial, resale or other business purposes may be subject to separate terms agreed with the Seller.


3. GENERAL PROVISIONS

These Terms and contracts concluded through the Website are governed by the laws of the Republic of Kazakhstan, subject to any mandatory provisions of applicable consumer protection law.

If the Customer is a Consumer, nothing in these Terms shall exclude, restrict or deprive the Consumer of any mandatory rights or protections available under the laws applicable in the country where the Consumer habitually resides.

Where mandatory consumer protection law provides the Consumer with greater protection than these Terms, such mandatory provisions shall apply to the extent required by law.

Nothing in these Terms is intended to exclude or limit any rights that cannot legally be excluded or limited.

By placing an Order, the Customer confirms that they have the legal capacity to enter into the purchase contract or have obtained any consent required under applicable law.


4. ORDERS AND CONTRACT FORMATION

Orders may be placed through the Website using the available checkout process.

When placing an Order, the Customer must provide accurate and complete information, including, where required:

  • full name;
  • billing and delivery address;
  • email address;
  • telephone number;
  • delivery method; and
  • payment information.

Submitting an Order constitutes an offer by the Customer to purchase the selected Products.

An automated email confirming receipt of an Order does not necessarily constitute acceptance of the Order.

An Order is considered accepted once the Seller expressly confirms acceptance, confirms dispatch of the Order, or otherwise performs the Order, unless applicable mandatory law provides otherwise.

All Orders are subject to availability.

The Seller may refuse or cancel an Order before dispatch where reasonably necessary, including in the event of:

  • lack of product availability;
  • an obvious pricing or product information error;
  • unsuccessful or rejected payment;
  • suspected fraud or unauthorized payment;
  • incomplete or inaccurate delivery information;
  • restrictions imposed by a Delivery Service or payment provider; or
  • legal, sanctions, export, import or other regulatory restrictions applicable to the transaction or destination.

If payment has already been collected for an Order that is subsequently cancelled by the Seller, the relevant amount shall be refunded using the original payment method where technically possible.


5. PRODUCT INFORMATION AND AVAILABILITY

TITRE TROIS makes reasonable efforts to ensure that product descriptions, photographs, measurements, prices and other information displayed on the Website are accurate.

Colours may appear slightly different depending on the Customer’s device, screen settings and lighting conditions.

Measurements displayed on the Website are approximate and minor variations may occur.

Natural variations in colour, texture, weave or finish that are inherent to natural fabrics, handmade elements or particular production techniques shall not in themselves constitute defects.

Product availability may change at any time.

Placing a Product in the shopping bag does not reserve that Product.


6. PRICES

Product prices are displayed on the Website in the currency selected or otherwise indicated at checkout.

The Seller may change prices at any time before an Order has been accepted. Changes shall not affect Orders already accepted by the Seller, except where required by applicable law.

If an obvious pricing error occurs, the Seller may contact the Customer before dispatch to offer the option of proceeding at the correct price or cancelling the affected Product. If the Order is cancelled after payment has been collected, the amount paid shall be refunded.

The Seller may offer promotions, discounts and promotional codes subject to their individual terms and validity periods.

Unless expressly stated otherwise, promotional codes cannot be combined.


7. PAYMENT

The Customer may pay using the payment methods made available at checkout.

Payments may be processed by third-party payment service providers. The Customer may therefore also be subject to the terms and privacy policies of the relevant payment provider.

The Seller does not receive or store full payment card details where payment information is processed directly by an authorized payment provider.

Depending on the Customer’s bank, payment method and selected currency, the bank or payment provider may apply currency conversion fees, international transaction fees or other charges. Such charges are outside the Seller’s control.

Where payment authorization is unsuccessful, the Seller is not required to process or dispatch the Order.


8. INTERNATIONAL DELIVERY

TITRE TROIS delivers within Kazakhstan and to international destinations supported by the Seller’s Delivery Services.

The availability of delivery to a particular country or territory is determined at checkout and may change from time to time.

The Seller may restrict or suspend delivery to particular destinations due to legal requirements, sanctions, customs restrictions, security concerns, carrier limitations or other circumstances outside the Seller’s reasonable control.

Delivery charges and estimated delivery times are displayed at checkout or communicated to the Customer before the Order is completed.

Delivery times are estimates only unless expressly stated otherwise.

International delivery may be affected by customs procedures, public holidays, weather conditions, transportation disruptions and other circumstances outside the Seller’s reasonable control.

The Customer is responsible for providing an accurate and complete delivery address.

The Seller shall not be responsible for delays or failed delivery caused by materially incorrect information provided by the Customer, subject to the Customer’s mandatory rights under applicable law.


9. CUSTOMS, DUTIES AND TAXES

International Orders may be subject to import duties, customs charges, local taxes, VAT, brokerage fees or other charges imposed by the destination country.

Unless expressly stated at checkout that such charges are included, import duties, customs charges and local taxes are not included in the Product price or delivery charge and are the responsibility of the Customer.

Customs rules vary between countries. The Seller does not control charges imposed by customs authorities or other government authorities.

The Customer is responsible for providing any information or documentation reasonably required for customs clearance.

If a Customer refuses to pay applicable customs charges, refuses delivery, or fails to provide information required for customs clearance and the Order is returned to the Seller, reasonable shipping, return, customs or other costs actually incurred by the Seller may be deducted from any refund to the extent permitted by applicable law.

Import duties or taxes paid directly to customs authorities or other third parties are generally not refundable by the Seller unless they were collected directly by the Seller and applicable law requires their refund.

Nothing in this section limits any mandatory rights available to the Customer under applicable law.


10. TRANSFER OF RISK

The risk of accidental loss of or damage to the Products passes to the Consumer when the Products are physically delivered to the Consumer or to a third party designated by the Consumer, other than the carrier, unless applicable law provides otherwise.

Delivery may be confirmed by signature, delivery code, electronic confirmation or another method used by the Delivery Service.

If an Order is confirmed as lost in transit before delivery to the Consumer, the Seller shall provide an appropriate remedy, including replacement or refund, as required by applicable law.


11. RETURNS AND RIGHT OF WITHDRAWAL

11.1 Return Period

TITRE TROIS accepts eligible Products purchased online for return within fourteen (14) calendar days from the date of delivery, unless a longer return or withdrawal period is required by mandatory consumer protection law applicable to the Customer.

Where applicable law provides the Consumer with a statutory right of withdrawal, the Consumer may exercise that right without providing a reason.

11.2 How to Request a Return

To initiate a return, the Customer must contact TITRE TROIS within the applicable return period by email at:

The return request should include:

  • the Order number;
  • the Customer’s full name;
  • the Product(s) the Customer wishes to return; and
  • clear photographs of the Product showing its current condition, including the original tags, labels and price tag attached to the Product.

The photographs should allow TITRE TROIS to verify that the Product is in its original condition before it is returned.

The Customer should not send the Product back until return instructions and the applicable return address have been provided by TITRE TROIS.

Where mandatory consumer protection law gives the Consumer a statutory right of withdrawal, the requirement to provide photographs or follow the above return procedure shall not limit or invalidate that statutory right where the Consumer has otherwise validly exercised it within the applicable period.


12. CONDITION OF RETURNED PRODUCTS

To be eligible for return under the TITRE TROIS return policy, the Product must be returned in its original condition.

In particular, the Product must:

  • be unworn and unused, except for reasonable fitting;
  • be unwashed, unaltered and undamaged;
  • be clean and free from stains, makeup, deodorant marks, perfume, body odour, pet hair or other signs of wear or use;
  • have all original brand labels, hangtags, security tags and price tags attached in their original position;
  • include any original accessories or components supplied with the Product; and
  • otherwise remain in a condition suitable for resale as a new Product.

TITRE TROIS reserves the right to refuse a return under its voluntary return policy if the Product has been worn, used, washed, altered or damaged, or if the original tags or price tag have been removed or are no longer attached to the Product.

Where mandatory consumer protection law grants the Consumer a statutory right of withdrawal or return that cannot be restricted by these Terms, such statutory rights shall remain unaffected.

Where permitted by applicable law, the Seller may reduce the amount refunded to reflect any decrease in the value of the Product resulting from handling beyond what is reasonably necessary to inspect and try on the Product.

Products showing signs of wear or use beyond reasonable fitting may be refused or may be subject to a reduction in the refund amount to the extent permitted by applicable law.


13. RETURN SHIPPING COSTS

Unless otherwise stated by TITRE TROIS or required by applicable law, the Customer is responsible for the cost of returning Products when returning Goods simply because they have changed their mind, the size is unsuitable, or they otherwise exercise a right to withdraw from the purchase.

TITRE TROIS shall bear reasonable return shipping costs where the Product:

  • is defective;
  • was damaged before delivery;
  • is materially different from the Product ordered; or
  • must otherwise be returned at the Seller’s expense under applicable law.

The Customer is responsible for securely packaging returned Products.

Where the Customer arranges the return independently, the use of a trackable delivery service is recommended.


14. REFUNDS

Once an eligible return has been received and processed, the Seller shall refund the amount due within the period required by applicable law.

Where a statutory right of withdrawal applies, the Seller shall provide the refund within the statutory period and may, where permitted by law, withhold the refund until the returned Products are received or the Consumer provides evidence that the Products have been sent back.

Refunds shall normally be made using the original payment method unless another method is agreed or required by law.

Where applicable law requires the Seller to refund the original delivery charge following the Consumer’s statutory withdrawal, the Seller shall refund the cost of the least expensive standard delivery method offered for the Order.

Any additional amount paid by the Customer for an expedited, premium or alternative delivery method is not refundable unless required by applicable law.

Currency exchange differences and fees charged independently by banks or payment providers are outside the Seller’s control and are not refundable by the Seller.


15. PRODUCTS EXCLUDED FROM RETURN

The right to return or withdraw may not apply to certain Products where an exception is permitted under applicable law.

This may include, for example:

  • Products made to the Customer’s specifications;
  • clearly personalized or customized Products;
  • sealed Products that are not suitable for return for health protection or hygiene reasons once the seal has been removed; and
  • any other Products expressly excluded from return under applicable mandatory law.

A Product shall not lose statutory rights relating to defects, non-conformity or incorrect delivery merely because it falls within a category excluded from change-of-mind returns.

Products purchased on sale or with a promotional discount remain subject to mandatory consumer rights unless applicable law expressly provides otherwise.


16. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS

If the Customer receives a Product that is defective, damaged upon delivery, or materially different from the Product ordered, the Customer should contact titretrois@gmail.com as soon as reasonably possible and provide the Order number and relevant details.

Photographs may be requested where reasonably necessary to assess the issue.

Depending on the circumstances and the mandatory law applicable to the Customer, available remedies may include:

  • repair;
  • replacement;
  • an appropriate reduction in price; or
  • cancellation of the purchase and refund.

Nothing in these Terms limits any statutory guarantee, conformity right or other mandatory remedy available to the Consumer under applicable law.

Where local law provides a mandatory legal guarantee period, including any statutory guarantee applicable to Consumers in the European Union, that mandatory period shall apply.


17. MADE-TO-ORDER AND CUSTOMIZED PRODUCTS

Products made specifically to the Customer’s measurements, specifications or individual requirements, or Products that are clearly personalized, may not be eligible for change-of-mind returns or statutory withdrawal where such an exception is permitted by applicable law.

This restriction does not affect the Customer’s rights if a customized Product is defective, damaged, incorrectly made compared with the agreed specifications, or otherwise non-conforming under applicable law.

Any specific conditions applicable to made-to-order Products shall be communicated before the Order is confirmed.


18. GIFT CERTIFICATES

Paid TITRE TROIS Gift Certificates may be used toward the purchase of eligible Products in accordance with the conditions stated on the Gift Certificate and these Terms.

If the value of an Order exceeds the available balance of the Gift Certificate, the Customer must pay the difference using another available payment method.

If the value of the Order is lower than the available Gift Certificate balance, the remaining amount shall continue to be available or shall otherwise be handled in accordance with the conditions applicable to the Gift Certificate and mandatory applicable law.

Any validity period applicable to a Gift Certificate shall be communicated when the Gift Certificate is purchased.

Nothing in the Gift Certificate terms limits any rights that cannot legally be excluded under applicable consumer law.


19. PERSONAL DATA AND PRIVACY

Personal data collected through the Website is processed in accordance with the TITRE TROIS Privacy Policy and applicable data protection legislation.

Depending on the Customer’s location and the circumstances of the transaction, this may include the legislation of the Republic of Kazakhstan, the General Data Protection Regulation (GDPR), and other mandatory data protection laws applicable to the processing.

Personal data may be shared with third parties where reasonably necessary to process an Order, including payment providers, Delivery Services, logistics companies, IT service providers and other service providers, subject to applicable data protection requirements.

20. INTELLECTUAL PROPERTY

All content available on the Website, including trademarks, logos, trade names, photographs, videos, product designs, graphics, texts and other materials, is owned by or licensed to TITRE TROIS unless otherwise stated.

Such content may not be reproduced, distributed, modified, commercially exploited or otherwise used without prior authorization from the relevant rights holder, except as permitted by applicable law.

Purchasing a Product does not transfer any intellectual property rights relating to that Product or the TITRE TROIS brand to the Customer.


21. LIABILITY

The Seller is responsible for its obligations in accordance with these Terms and applicable law.

The Seller shall not be responsible for damage caused by improper use, care, washing, storage, alteration or handling of a Product after delivery where the damage is not attributable to a defect or non-conformity for which the Seller is legally responsible.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in these Terms limits the statutory rights of Consumers.


22. FORCE MAJEURE

The Seller shall not be liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond the Seller’s reasonable control.

Such circumstances may include, where applicable:

  • natural disasters;
  • fires;
  • war or armed conflict;
  • civil disturbances;
  • epidemics or public health emergencies;
  • government restrictions;
  • sanctions or trade restrictions;
  • customs restrictions;
  • transportation interruptions;
  • strikes affecting third-party services;
  • failures of telecommunications or payment infrastructure; and
  • other comparable events outside the Seller’s reasonable control.

This provision does not affect any mandatory rights the Customer may have under applicable law.


23. MANDATORY CONSUMER RIGHTS

Nothing in these Terms is intended to exclude, restrict or limit any rights granted to Consumers under mandatory applicable consumer protection law.

If any provision of these Terms conflicts with a mandatory provision of law that applies to the Consumer or the transaction, the mandatory provision shall prevail to the extent of that conflict.

The remaining provisions of these Terms shall continue to apply.


24. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and contracts concluded through the Website shall be governed by the laws of the Republic of Kazakhstan, without prejudice to any mandatory consumer protection rights that apply to the Consumer under the laws of the country in which the Consumer habitually resides.

The Customer and the Seller shall first make reasonable efforts to resolve any complaint or dispute amicably.

Complaints may be submitted to:

If a dispute cannot be resolved amicably, either party may refer the dispute to a competent court, consumer protection authority or other competent dispute resolution body in accordance with applicable law.

Nothing in these Terms limits a Consumer’s right to bring proceedings before a court or competent authority available to them under mandatory consumer protection or procedural law applicable in their country of residence.


25. CHANGES TO THESE TERMS

The Seller may update these Terms from time to time to reflect changes in business operations, services, payment or delivery arrangements, or applicable legal requirements.

The version of the Terms applicable to an Order is the version in effect when that Order is placed, unless mandatory applicable law requires otherwise.

Changes published after an Order has been accepted do not retroactively alter the terms of that Order.


26. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be applied to the maximum extent permitted by law or, where necessary, severed from these Terms.

The validity and enforceability of the remaining provisions shall not be affected.
